## Fines by speed

## 70 mph zones: CVC 22356

[Vehicle Code 22356](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=VEH&sectionNum=22356)(a) lets the Department of Transportation, with California Highway Patrol approval, declare a higher maximum of 70 mph on specified state highways. It must put up signs.

Under subsection (b), no one may drive above 70 mph on that highway, as posted. If you were cited near 70, check that the segment was posted.

## Over 100 mph: CVC 22348(b)

Driving above 100 mph is an infraction under [22348(b)](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=VEH&sectionNum=22348).

The statewide 2026 schedule lists a base fine of $200 and a total of $860.80. Santa Clara County's schedule marks a mandatory court appearance and a DMV report for this offense, and lists it as not eligible for traffic school.

The fine amount in the statute and any license consequence depend on your offense history, so read the section and ask the court.

## Points

A conviction for speeding above 65 or 55 mph adds 1 point under [Vehicle Code 12810](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=VEH&sectionNum=12810)(f). A conviction under 22348(b) adds 2 points. ## Frequently asked questions

### Do I have to appear in court for 100 mph?

Check your notice, which says whether you must appear. Santa Clara County's 2026 schedule marks speeding over 100 mph under 22348(b) as a mandatory court appearance. Other courts may differ. If your notice is unclear, call the traffic clerk before the due date.

### Is 22349 the same as 22350?

No. Section 22349 sets fixed maximum speeds: 65 mph generally, and 55 mph on two-lane undivided highways unless posted higher. Section 22350 has no number and asks whether your speed was reasonable or prudent for conditions. Your citation names the section, so read it first.

### Can I take traffic school for going over 65?

Possibly. Vehicle Code 42005 lets holders of a noncommercial class C, M1 or M2 license attend. Sacramento's court lists extra conditions, including no mandatory appearance and a moving violation carrying a point. Ask your court whether your specific charge qualifies before you pay.

### What is 22348(a)?

Section 22348(a) bars driving faster than the speed limit set under section 22349 or 22356. It links the posted limit to the offense. Subsection (b) is separate and covers driving over 100 miles per hour, which is an infraction with its own penalties.
